1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of the websites, forms, and messaging services provided by Business Buddy Inc, doing business as LeadsFlow180 ("LeadsFlow180," "we," "us," or "our"). By accessing or using the Services, submitting a form, or opting in to our text messaging program, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.
2. The Services
LeadsFlow180 provides marketing and lead-generation services for contractors and home-service businesses, including scheduling of strategy calls, appointment communications, and related promotional content. We may modify, suspend, or discontinue any part of the Services at any time.
3. SMS / Text Messaging Terms
Consent is not a condition of purchase. By opting in, you agree to receive recurring automated marketing and transactional text messages from LeadsFlow180 at the mobile number you provide.
When you opt in to the LeadsFlow180 SMS program, the following terms apply:
- Program & message types: you will receive appointment confirmations and reminders, account and customer-care notifications, and marketing and promotional offers.
- Recurring, automated messages: messages may be sent using an automatic telephone dialing system or similar technology.
- Message frequency varies based on your interactions with us.
- Message and data rates may apply, as charged by your mobile carrier. You are responsible for these charges.
- Opt out: reply STOP at any time to cancel. After you send STOP, we will send one confirmation message and then stop sending messages, unless you opt in again.
- Help: reply HELP for assistance, or contact us using the details in Section 12.
- Opt back in: reply START (or resubmit the sign-up form) to resume messages.
- Supported carriers: major U.S. carriers are supported. Carriers are not liable for delayed or undelivered messages.
- Eligibility: you confirm that you are the account holder or authorized user of the mobile number you provide, and that the number is a U.S. mobile number capable of receiving SMS.
Mobile opt-in information and consent are handled as described in our Privacy Policy and are not shared with third parties or affiliates for their own marketing.
4. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use the Services.
5. Acceptable Use
You agree not to use the Services to:
- Violate any applicable law or regulation, including the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act;
- Submit false, misleading, or unauthorized information, including a phone number that is not yours;
- Interfere with or disrupt the Services or attempt to gain unauthorized access to any systems;
- Infringe the intellectual property or privacy rights of others.
6. Intellectual Property
The Services, including all content, trademarks, logos, and software, are owned by or licensed to LeadsFlow180 and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written permission.
7. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
8. Limitation of Liability
To the fullest extent permitted by law, LeadsFlow180 and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Services. Our total liability for any claim will not exceed one hundred U.S. dollars (US$100).
9. Indemnification
You agree to indemnify and hold harmless LeadsFlow180 from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services or your violation of these Terms.
10. Governing Law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles. Any dispute will be resolved in the state or federal courts located in Massachusetts, and you consent to their jurisdiction.
11. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and revise the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
